These Terms govern your use of Shikaticko.

1. Introduction
Welcome to ShikaTicko, a premium digital ticketing and event management platform operated by GrooveHQSolution Limited ("we", "us", "our"). By accessing or using the Platform or any related services (collectively, the "Service"), you ("User") agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
2. Definitions
- Attendee: A User who purchases, registers for, or attends an Event via the Service.
- Event Organiser: A User who creates, promotes, manages, or sells tickets for an Event.
- Event Ticket: Digital or physical proof of purchase or entitlement to access an Event.
- Media Content: Photographs, video recordings, audio recordings, or livestreams captured at an Event.
3. Eligibility & Account Registration
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. Users under 18 may only use the Service under direct supervision of a parent or legal guardian.
You are solely responsible for maintaining the confidentiality of your login credentials and all activities conducted under your account. You must notify us immediately of any suspected unauthorized use at info@shikaticko.co.ke.
4. Prohibited Events, Content & Conduct
You shall not list or promote any Event that is unlawful under Kenyan laws or involves scalping, counterfeit tickets, or breaching venue capacity and safety laws.
You agree not to use the Service for unlawful purposes, upload infringing content, disrupt the Service, or attempt unauthorized access.
5. Organiser Compliance Obligations
Organisers warrant compliance with Kenyan licensing requirements, venue capacity laws, tax obligations, and consumer protection laws. Organisers are solely responsible for the accuracy of Event information and fulfilling promises to Attendees.
6. Ticketing, Payments, Refunds
- Payments processed through approved Kenyan payment channels
- All ticket prices quoted in Kenyan Shillings (KES)
- Refunds governed by Event Organiser's policy
- Transaction and service fees are non-refundable
- ShikaTicko remits Organiser Revenue within T+2 working days after Event completion
7. Platform Availability
The Service is provided "as is" and "as available", without warranties of any kind. We may temporarily suspend access for maintenance and are not liable for interruptions beyond our control.
8. Intellectual Property
All software, trademarks, logos, and proprietary Content remain the exclusive property of GrooveHQSolution Limited. You are granted a limited, revocable, non-exclusive licence to access the Service for personal, non-commercial use.
9. Media Content
By attending an Event managed through ShikaTicko, you grant the Event Organiser and ShikaTicko a licence to use Media Content featuring your image for Event documentation, security, marketing, and promotional activities. You may withdraw consent for future marketing use by contacting us.
10. Limitation of Liability
GrooveHQSolution Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, or for personal injury or property loss occurring at an Event.
11. Indemnity
You agree to indemnify and hold harmless GrooveHQSolution Limited from any claims, damages, or losses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
12. Dispute Resolution
Disputes shall first be resolved through good-faith negotiations. If unresolved within 30 days, disputes shall be submitted to mediation, then arbitration in Nairobi under the Arbitration Act 1995.
13. Governing Law
These Terms are governed by the laws of the Republic of Kenya. The courts of Kenya shall have jurisdiction to settle any disputes.
14. Modification of Terms
We may modify these Terms periodically. Revised Terms take effect upon posting on www.shikaticko.co.ke. Material changes will be communicated at least 30 days in advance.
15. Force Majeure
We shall not be liable for any failure to perform our obligations due to Force Majeure Events including pandemics, government actions, infrastructure failures, or acts of terrorism.
